Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the C-Hub mobile application and related services (the “Service”), provided by Nuvola Digital and Anvil Development Agency (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use the Service. You may not use the Service if you are barred from doing so under applicable law.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at pb@ada-anvil.io if you suspect unauthorized access. We may require identity verification (KYC) before allowing certain activity.
3. The C-Hub marketplace
C-Hub allows users to collateralize eligible rewards (such as airline miles, travel credits, and points) into transferable assets, list those assets on a secondary marketplace, and de-collateralize purchased assets back into the original program. We do not own, issue, or guarantee the underlying rewards, and the availability and value of those rewards depends on the policies of the issuing program.
4. Fees
The Service may charge fees for collateralization, transactions, royalties, redemptions, and membership. Applicable fees are disclosed in the app before you confirm a transaction. Fees are non-refundable except as required by law.
5. Acceptable use
You agree not to:
- Use the Service in violation of any law or third-party rights, including the terms of any rewards program.
- Attempt to circumvent identity verification, fraud-prevention, or security controls.
- Submit false, misleading, or unauthorized rewards or listings.
- Interfere with or disrupt the Service or its infrastructure.
- Use the Service for money laundering, terrorism financing, sanctions evasion, or any other illicit purpose.
6. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or the Service is being used unlawfully or unsafely. You may close your account at any time by contacting support.
7. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any rewards or transactions will be accepted by third-party programs.
8. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD $100.
9. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
10. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of the Service after the update means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which the operating entity is established, without regard to its conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless you and we agree otherwise.
